Compliance with Local Laws

You agree that riding above legal limits is done solely at your own risk. You are responsible for complying with federal, state, and local laws regarding e-bike classification, speed, and power.

High-Power / Full-Power Mode

Unlocking or using Full-Power Mode (via the Spectrx app or otherwise) may exceed legal limits. This mode is intended only for private property or off-road areas where permitted. You accept full responsibility for any consequences.

Limitation of Liability; No Punitive Damages; Liability Cap

To the fullest extent permitted by law, our total liability shall not exceed the amount you paid for the product. You waive any right to claim punitive, special, indirect, or consequential damages.

Section 14 - Indemnification

You agree to indemnify and hold harmless Nireeka US, Nireeka Inc., and affiliates from any claims arising from:

• Your breach of these Terms
• Your violation of any law
• Your modification, misuse, or illegal operation of the product
• Your unlocking or use of Full-Power Mode
• Third-party claims caused by your actions

Section 15 - Severability

If any provision is unenforceable, it shall be severed without affecting the rest.

Section 16 - Termination

These Terms remain effective unless terminated. If you violate them, we may terminate access immediately.

Section 17 - Entire Agreement

These Terms constitute the entire agreement between you and us.

These Terms and any purchases shall be governed by U.S. law and the laws of the State of Delaware.

Section 19 - Mandatory Arbitration

Any dispute related to these Terms, your purchase, your use of the product, or Full-Power Mode shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA). You waive any right to a judge or jury trial.

You agree that disputes may only be brought individually. No class actions or representative claims are permitted.

Section 21 - Limitation Period

Any claim related to these Terms or the product must be filed within one (1) year, or it is permanently barred.
